DIY Divorce

We prepare the summons and particulars of claim and furnish you with a detailed, easy to follow, step – by – step guide in order to get your divorce concluded in the regional division of the magistrate’s court in your area. The process involves attending court for issue of the divorce summons, delivering the summons and accompanying documents to the Sheriff of the Court for service, attending court again to file the documents (and see the Family Advocate if there are children involved) and acquiring a date when your case will be heard, in order for you to obtain a final order/decree of divorce. Only the Plaintiff is required to appear in court in an unopposed divorce hearing.

We can also prepare and draft you and your spouse a settlement agreement should same be required at an additional fee to further expediate the finalisation of the divorce.

Should we require our office to apply for a court date on your behalf and set the matter down and prepare the documents for court on your behalf a further fee will be charged dependant on the area your regional court is situated in.

The Steps

STEP 1

Complete the detailed divorce Questionnaire.

STEP 2

Pay R1000.00 to generate your divorce summons and particulars of claim or Pay R2000.00 to generate your divorce summons and particulars of claim and settlement agreement.

STEP 3

We will then email it to you or make it available for collection so that you can finalise your divorce in court. We will email you a guide on the steps to follow and be available via e-mail should you have any further questions.

Your Responsibilities

Go to Court to issue your Summons and annexures at the Registrar of court (we will inform you which court in your area you need to go to). Kindly make three (3) copies of the summons and particulars of claim.
Once the papers are issued at court, you will need to take the documents to the sheriff of the Court for service on the Defendant.
Costs to serve the documents vary from Sheriff to Sheriff and such costs will be paid upfront to the Sheriff.
Where there are minor children involved you will have to go to the Family Advocate in your area to endorse either the Summons or a settlement agreement.
Go back to Court (Registrar) and request a date for the hearing after expiry of the 10 days or 20 days if your spouse is in another province.
Appear in court on that date given to you by the Registrar or as applied for by our office on your behalf.
An Attorney (or Advocate) may be appointed for you in your regional court jurisdiction if requested at an additional cost to you and will then accompany you to divorce court for the hearing and finalisation of your matter.

Should an attorney and/or advocate be required to assist in the divorce process at your request, it will result in an additional charge of an amount not exceeding R1000.
